Some myths about PPi Claims
Many people are under the illusion that they have a better chance of winning if they use a solicitor for making their ppi claims, this is completely incorrect and as many charge fees greater than 15% you could be costing yourself money. The Financial Ombudsman has said that you have the same chance of success if you make the claim by yourself and the other question you should ask yourself is would people dealing with your claim who have financial qualifications and previously worked in the industry not have a better understanding of how these policies were missold in the first place.
Other myths are that you can only make 1 ppi claim even although you have had several policies with the same company and again this is incorrect as you are entitled to claim on every ppi policy that was missold.
PPI Claims Facts
Over £13 million of fines have been handed out to companies by the FSA for misselling PPI
£12 billion has been set aside buy the banks and other financial institutions for claims
Over 80% of complaints are upheld by the Financial Ombudsman
You can make ppi claims by yourself
MOJ has cancelled the licence of over 500 claims management companies
People are being over charged by claims management companies who charge more than 15% for the service ( in our opinion)
Banks are making it harder to make a claim
Firstly you need to submit a letter to the bank or financial institution who sold you the policy setting out the reasons you feel the ppi was missold to you in the first place. You will need to include details such as agreement number and your address at the time the agreement was taken out.
The company or Bank has 8 weeks in which to respond to your complaint and either uphold it or reject it at this point. It is not compulsory at this stage to complete the Financial Ombudsman Questionnaire even although your bank will request it as long as you have given adequate reason in your letter.
If your complaint is upheld you will be paid redress within 28 days but if it is rejected then you have the opportunity to take your case to the Financial Ombudsman for a final decision.
When taken your case to the Financial Ombudsman you must complete the claim form and the PPI questionnaire and send them along with your final decision letter from the company to the Financial Ombudsman who will then decide if your case should be upheld or not. If the Financial Ombudsman does not agree with you then you have one final chance to request a review from their service at this time which will allow you one last chance to get the decision overturned.
If this fails and you still feel strongly about your case you still have the right to take the matter to court as a last resort and based on the judicial review and the FSA guidelines your prospects of winning the case could be good.
This is a quick guide to the process to give you an informed choice whether you wish to make the claim by yourself our use the services of a claims management company like Money and Me Claims.
Why use a Claims Management Company
Many people want to use the services of a claims management company for a variety of reasons and here is just an example of some of those reasons.
We do not have the time to deal with it by ourselves.
We do not want the hassle of dealing with the banks.
We do not trust the banks to deal with our ppi claim.
We do not want the hassle of all the paperwork and possibly having to deal with the Financial Ombudsman claim form and ppi questionnaire as these are too lengthy.
We think we will have a better chance of success using a claims company.
This is just an example of some of the reasons we have been given by customers who used our service when making their ppi claims but we have had many other reasons so whatever your reason you can be assured we will endeavour to make the process as easy as possible for you.
The choice is yours
Whatever path you decide to take when making your claim whether it be by yourself or with the help of a claims company there is one thing we would recommend in all cases.
Always start your process by requesting your file from the bank or financial institution by way of a Data Subject Access request which will cost you £10 made payable to the bank or financial institution if your agreement ended within the last 6 years as you will be surprised what this may unveil in your favour. One of our clients who took our advice on this ended up being compensated for their pension, investment and mortgage protection advice on top of their PPI claim so it is worth the £10 and will give you a full insight into the information held about you by that company.
Good luck whatever course you decide and remember we are here to help and only a phone call away to help with your claim.
